Commercial Dispute Resolution is essentially disputes in a commercial context. Most commonly it involves disputes between businesses and relates to the commercial agreements that they have with each other.
Litigation is where parties attempt to resolve their dispute through the formal court system.
Arbitration is a form of Alternative Dispute Resolution (“ADR”), where parties jointly appoint an arbitrator/panel of arbitrators to hear the dispute and make a decision which, whilst not made through the court system, is usually binding and enforceable in the courts.
Mediation is another method of ADR. Here, the parties appoint an independent mediator to diplomatically work with the parties on a Without Prejudice basis to bring them together and try to resolve the dispute without the need for court proceedings.
Dispute Resolution is complicated, stressful, time-consuming and potentially expensive.
