    How can our unfair dismissal team help you?

    What could you be entitled to?

    If you are employed under a contract of employment, whether or not it is in writing, and you have been dismissed or have resigned, you may be entitled to bring a claim at the Employment Tribunal for unfair dismissal. In most cases, you must have been employed for a period of two years or more at the date of your dismissal to be eligible to bring a claim.

    If you have not been employed for two or more years at the date of your dismissal, but you believe that you were dismissed due to, for example, your having made a request for maternity leave, your having participated in Trade Union activities, or your having raised your participation in matters in relation to health and safety, you may be able to bring the claim despite your lack of sufficient service.

    If you have resigned, in order to successfully claim unfair dismissal you must be able to show that your employer (or a colleague) committed a serious breach of your contract of employment, for example by behaving in a way which seriously damages your trust and confidence in the employer, and that you have resigned as a consequence of the breach within a reasonable period of time.

    What happens next?

    If you have been invited by your employer to attend disciplinary or performance related proceedings, or you have been given notice of potential redundancy, we can assist you prior to dismissal by advising you on how to respond to any allegations or to proposed redundancy, and if appropriate we can contact your employer on your behalf to attempt to settle the matter and avoid the need to bring a claim at the Employment Tribunal.

    Since July 2017, it is free to issue a claim at the Employment Tribunal and you will not be required to pay a hearing fee.
