What are easements?
Easements which give a right of use to a person over the land of another, such as a right of way across land. This is different from a Profit a Prendre which gives a right to a person to enter on to another person’s land and remove soil or other items such as timber from the land.
Enforcing easements can be distressing if you are being prevented from exercising your rights or you are being prevented from accessing a right of way or other easement.
What are restrictive covenants?
Separate to Easements and Profits a Prendre are restrictive covenants which can also have an effect upon land. A restrictive covenant is a contractual arrangement which limits what the owner of the land or the Lessor can do with the land.
