    What is discrimination in the workplace?

    Discrimination in the workplace occurs when someone is treated less favourably because of their sex, race, religion, disability, age or sexual orientation. It can be direct or indirect and can also take the form of victimisation.

    Victimisation happens when an employee has made a formal complaint of discrimination or made a claim of discrimination to the Employment Tribunal and is treated less favourably for doing so.

    Our London employment team has a wealth of experience in this area and have advised both employees and employers on all areas of discrimination.

    If you believe that you have been discriminated against at work then you may be able to make a claim against your employer. If you are still in employment then you may wish to make a formal complaint (grievance) against your employer and we can advise you on how to make a complaint. However, in practice, often this is not possible.

    We can advise you as to whether you have a claim and, if so, we can then guide you through the Employment Tribunal process. If the claim is successful the Employment Tribunal have the ability to award you compensation as well as recommending that the employer makes changes in order to improve the situation.

    Discrimination claims do often overlap with other areas of law and particularly with claims for unfair dismissal where an employee has been dismissed or resigned. If you are unsure as to your position please contact our solicitors who will be happy to advise you on any potential claims.
